Terms of Service

These Terms of Service (“Terms”) govern your use of the Hakim Health coaching service (the “Service”), operated by Mo Hakim (“Hakim Health,” “we,” or “us”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

Hakim Health provides health coaching, not medical care. The Service is intended for adults seeking guidance on training, nutrition, sleep, and recovery as part of a general wellness program. We do not diagnose, treat, cure, or prevent any disease or medical condition.

Information, recommendations, and content provided through the Service are educational only. They do not constitute medical advice and do not replace the services of a licensed physician, nurse practitioner, dietitian, mental-health professional, or other healthcare provider. Always consult your healthcare provider before starting a new exercise program, making significant nutrition changes, or modifying any clinical protocol (including hormone therapy, peptides, medications, or supplements).

You assume all risks associated with following the Service’s recommendations. Stop and contact a medical professional immediately if you experience pain, dizziness, chest discomfort, or any concerning symptom during exercise or as a result of changes you make.

You must be at least 18 years old and able to enter into a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide during signup and intake is accurate and complete.

You are responsible for disclosing any medical conditions, medications, injuries, or limitations that may affect your ability to safely participate in training or nutrition guidance.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted under your account. Notify us immediately at hello@hakimhealth.co if you suspect unauthorized access.

We reserve the right to suspend or terminate accounts for violation of these Terms, fraud, abuse, or non-payment.

Access to the Service requires an active paid subscription. By subscribing, you authorize us, through our payment processor Stripe, to charge your selected payment method on a recurring basis until you cancel.

• Billing cycle: subscriptions renew automatically on a monthly basis at the price shown at checkout.
• Cancellation: you may cancel at any time from the Billing page inside your account. Cancellation takes effect at the end of your current billing period; you retain access until that date.
• Refunds: payments are non-refundable except where required by law. We will consider refund requests for technical issues or extenuating circumstances on a case-by-case basis.
• Price changes:we may change subscription pricing with at least 30 days’ notice. Existing subscriptions retain their original pricing until the next renewal after the notice period.
• Failed payments: if a payment fails, we may suspend access until payment is resolved.

When you subscribe, you receive personalized programming, nutrition guidance, weekly review, and direct access to your coach. Coaching responses are typically delivered within 24 hours on business days but are not guaranteed to be instantaneous. The Service is not a substitute for emergency medical care.

You agree to communicate openly with your coach about injuries, fatigue, life circumstances, and your clinical context so the coaching can be tailored appropriately.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Share your account credentials with another person or use someone else’s account.
• Resell, redistribute, or commercialize content produced through the Service without our written permission.
• Attempt to reverse-engineer, scrape, or otherwise extract data from the Service beyond features explicitly provided to you.
• Submit false, misleading, or harmful information (including misrepresenting health conditions to obtain different programming).
• Use the Service to harass, threaten, or impersonate any person.

The Service, including all programming templates, methodologies, written content, code, designs, and branding, is owned by Hakim Health and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial coaching purposes during your active subscription.

Content you submit (your training logs, photos, journal entries, messages) remains yours. You grant us a license to use that content solely to operate, improve, and support the Service.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that the Service will be uninterrupted, secure, or error-free.

We do not warrant that you will achieve specific results, weight changes, strength gains, or any particular health outcome from using the Service. Results vary widely based on individual physiology, adherence, sleep, stress, genetics, and many other factors outside our control.

To the maximum extent permitted by law, Hakim Health and its officers, employees, contractors, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claim arising from these Terms or your use of the Service will not exceed the amount you paid us for the Service in the twelve months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the fullest extent permitted by law.

You acknowledge that physical training carries inherent risks of injury. You voluntarily assume those risks. To the extent permitted by law, you release Hakim Health from any claims arising from injury, illness, or other harm related to your use of the Service, except claims arising from our gross negligence or willful misconduct.

You agree to indemnify and hold harmless Hakim Health from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from: your use of the Service, your violation of these Terms, or your violation of any third-party right.

You may stop using the Service at any time and delete your account from Settings. We may suspend or terminate your access at our discretion for violation of these Terms, non-payment, fraud, abuse, or any reason that materially harms the Service or other users.

Sections that by their nature should survive termination — including ownership, disclaimers, limitation of liability, indemnification, and dispute resolution — survive.

We may update these Terms from time to time. Material changes will be communicated by email or through the Service before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, discontinue use and cancel your subscription.

These Terms are governed by the laws of the state in which Hakim Health is established, without regard to conflict-of-laws principles. Before bringing any formal legal action, you agree to first contact us at hello@hakimhealth.co so we can attempt to resolve the issue informally.
